Privacy Policy
In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, hereinafter referred to as “the Law”, this Privacy Notice is issued under the following terms:
RESPONSIBLE FOR PERSONAL DATA
For the purposes of this Privacy Notice, GUADALAJARA REALTY, S.A. DE C.V., (hereinafter “THE COMPANY”) with an address at Rubén Darío 843-A, Colonia Prados Providencia, CP 44670, Guadalajara, Jalisco, is responsible for the collection, disclosure, storage, use, management, utilization, transfer, and/or disposal of personal data collected from its Clients (hereinafter “the Holders”).
PERSONAL DATA COLLECTED
The personal data collected by the responsible party from the Holders include, but are not limited to, the following: Name, home address, email, age, date of birth, sex, marital status, nationality, phone number, occupation, tax identification number (RFC), current work data, and a copy of official identification with a photograph. Your personal data are collected in person, via email, or through the submission of documents that prove the aforementioned data.
Sensitive Data Policy
As a policy, the responsible party does not request any information that is considered as sensitive data under the Law, such as religion, sexual preferences, political opinions, among others. The Company supports and promotes diversity and therefore prohibits any discriminatory act or request for any information that could imply discrimination. In case you provide sensitive data, The Company will treat and safeguard it in terms of the Law.
PURPOSE OF PERSONAL DATA PROCESSING
The data we collect is for the purpose of (i) drafting a service provision contract between the Responsible and the Client to establish the terms and conditions regarding the promotion of the Client’s property; (ii) for the preparation of lease agreements, promise to purchase-sale, purchase-sale, transfer, investment projects on properties managed by the Responsible; (iii) to carry out any management that allows confirming the legal situation of the property managed by the Responsible; (iv) to coordinate appointments with Prospects at the property’s address owned by the Client and managed by the Responsible; (v) to exchange information and proposals between the Prospect and the Client related to the property managed by the Responsible; (vi) to investigate the credit and legal integrity of the Client under the Law of Domain Extinction; (vii) with the purpose of closing all types of real estate operations between the Prospect and the Client. Similarly, the personal data collected may also be used to attend legal requirements from competent authorities.
THE COMPANY is not responsible for the veracity or accuracy of the data you have provided nor has it verified them but only receives, records, and preserves them. Also, you declare and confirm that you have explicit consent from those whom you also provide personal information, such as spouse, partner, economic dependents, relatives, professional references, etc.
OPTIONS AND MEANS THAT THE RESPONSIBLE OFFERS TO THE HOLDERS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA
The personal data of the Holders will be treated with strict confidentiality, taking care of administrative, physical, and technical security measures that the responsible implements in its internal security policies and procedures avoiding possible illicit disclosure of data and limiting their use to what is established in this Privacy Notice.
MEANS TO EXERCISE THE RIGHTS OF THE HOLDER
At any time you or your legally accredited representative may exercise your rights of Access, Rectification when you consider them incorrect or inaccurate, Cancellation if you believe that the data are not treated properly and Opposition if you do not want your data to be processed for specific purposes. The exercise of one does not prevent the exercise of another and none is a prerequisite for exercising another.
To exercise your ARCO rights, you must submit your request at our address located at Rubén Darío 843-A, Colonia Prados Providencia, CP 44670, Guadalajara, Jalisco, or send it to our personal data department at info@sirguadalaiara.com , addressed to the data protection department. The request must contain the following information: (i) Name of the holder, (ii) address and email address to notify you of the response to your request, (iii) a clear and precise description of the data for which you seek to exercise the corresponding right, (iv) the purpose of the request, (v) any element that facilitates locating the data, and a copy of your identification must be attached, and where appropriate, the document accrediting legal representation.
The response time for your request will be 20 business days from the day your request for access, rectification, cancellation, and opposition was received. The response will be communicated within the aforementioned period to the email address you provided in your request or by sending a letter to the address provided in the same. Once such notification is received, you will have a period of 15 business days to make it effective if applicable.
At any time, you may revoke the consent you have given us for the processing of your personal data, so that we stop using them. For this, you must submit a request in the terms mentioned for the exercise of ARCO rights. The procedure to follow will be the same as that provided for the exercise of ARCO rights. If your request is applicable, your data will no longer be processed by THE COMPANY.
